Liability under The Animals Act 1971


If you are a horse owner or landowner you may be responsible for any damage caused by your horse or the horses that are kept on your land. If you are a livery yard owner, trainer or have a horse on loan you will be responsible for the horse (in your possession and control) and therefore liable for any damage caused by those horses.

You may be liable for the following:

  • Damage caused to people or property under the Animals Act 1971;
  • Damage caused by a horse escaping due to poor fencing of your land or adjoining land;
  • Damage caused to or by straying horses;
  • Injury caused to users of rights of way or exercising their "right to roam";
